2. What data do we process?

2.1. Data provided by the data subject:
TENDAM may collect personal data that you provide us directly through the different forms you fill in.

Within these forms you can check how some of the fields are marked as mandatory and that without this information we cannot provide the requested service.

Additionally, the development of our relationship generates a series of information such as transactional data (for example, information that you provide us with about your purchase tickets, orders, returns, etc.), connection and browsing data through the different web pages, historical claims and incidents. This information is processed by TENDAM since it is of great value both at a statistical and aggregate level - because it allows us to know our typology of clients, what products are liked more or less, how shall we configure the web page so that it is easier to navigate ... – as well as individually to be able to offer personalized advertising based on the customer segment: age range, type of products previously contracted and time of purchase ...

Finally, and only if you authorise us to do so, we can process your truncated card number (i.e. partially encrypted) to remember your payment method and to make the purchase process easier. To ensure your payment information is kept secure, we will never hold your full card number.

2.2. The data not consciously provided by the user resulting from the application of algorithms (inferred data):
It is true that, increasingly, companies use data that has not been provided consciously by the data subject. This data, called "inferred data", is the data resulting from the application of algorithms to analyse a variety of data, such as social communication media and purchasing records in order to profile people, for example, to know the interest of our customers for certain products, shopping moments, tastes, shopping history, promotions consumed, satisfaction surveys, information on calls to our Customer Service, navigation made on the TENDAM websites, etc.

2. Send commercial information about Products and Services of our Brands.

Tendam Retail, S.A. owns the brands: Cortefiel, Pedro del Hierro, Springfield, Women'secret, Fifty...

We understand that, as a user registered voluntarily in any of the Loyalty Clubs of TENDAM, you expect to receive information about the offers, promotions and discounts of all our products. We may also send you information about products or services owned by third parties, with whom TENDAM has agreements in place for distribution or production under licence.

Therefore, based on the legitimate interest, we will send you this commercial information through the different means of contact (electronic and non-electronic): postal address, e-mail, mobile phone (SMS, RCS), amongst others.


3. Profiling and marketing

Through this purpose, TENDAM collects and processes data for the analysis of purchases (amounts, frequency, data from the physical store where you buy and / or the online store), if you benefit from being a member of one, or several, of our Clubs, of your interests and preferences, so that this information allows TENDAM to offer you products and services that may interest you, and not others.

The processing of data for the purpose of profiling and marketing is based on the legitimate interest of TENDAM. To this end, TENDAM has pondered the interests and rights of the data subjects, and the measures adopted by the data controller to fulfil its general obligations in terms of proportionality and transparency, and has concluded that:

1.- The impact on the fundamental rights and public liberties of the people is reduced;
2.- The referred processing can be reasonably foreseen by the data subject who is interested in receiving personalized offers and, on the contrary, is annoyed by the generic advertising;
3.- The processing of data with the above purposes, does not result in exclusion, discrimination, defamation, or situations that put at risk the reputation of the data subject and / or the negotiating power.

The analysis carried out will aim to identify which products and services are more related to different user groups that share common features (e.g.: age) or similar buying habits (e.g.: dates in which they usually buy).

4. Respond to your request for information about the nearest store based on geolocation.

The geographical location is disabled by default. Only in the cases in which you request us, with the consent of the user, information about our nearest store will be activated to respond to the request sent.

Although browsing considering geographic location is always a user's choice, in cases where you reject access to location data, the Platform will not be able to offer you the functionalities based on that location. In no case, the Platform will continuously monitor the location of the user.

The personal data provided will not be retained once the information request has been answered.


5. Management and analysis of web browsing

TENDAM is subject to different regulations that imply the need to process personal data in order to comply with them, for example with the tax regulations.

In compliance with these obligations, TENDAM may communicate its data to the Public Administrations or competent courts, provided that the request is made through the established legal channels.

4. How can you stop receiving commercial offers?
In all the commercial communications that we send you by electronic means, a link will be enabled -UNSUBSCRIBE or similar- that will allow you to manage your privacy and request that no new commercial communications will be sent. Also, you can revoke your consent or express your opposition through any of the following means:

  • - - Managing your privacy options through MY ACCOUNT (or similar) section for those users who have registered their account on any of our websites or who are members of one of our loyalty clubs.

The processing time is 48-72 hours so it is possible that in this time you may receive some commercial communication.

5. How long do we conserve your data?
If you have registered as a client on our website, your personal data will be conserved as long as you do not request your withdrawal, as we understand that, in the meantime, you are still interested in keeping your account regardless of whether your activity as a member and/or customer could be interrupted during a period of time. If you have not registered as a customer but make an online purchase your data will be kept until you confirm that the order has been delivered without incident and no complaints.

Once you request your withdrawal or confirmed that the order has been delivered without incident and no complaints, your data will be deleted in accordance with the provisions of the data protection regulations implying their blocking, being available only at the request of judges and courts, the Public Prosecutor or the competent Public Administrations during the limitation period of the actions that could derive to be subsequently eliminated.

The prescription periods vary depending on the type of service, for exemplary purposes, with a general nature, the limitation period for the majority of personal civil actions is 5 years.

6. Will we share your information with third parties?
In order to fulfill the purposes described in the present Privacy Policy, we need to give access to your personal data to entities of the Tendam Group, and in particular Tendam Retail Services, S.A., for the sole purpose of providing an internal administrative management service.

Likewise, for the management of customer services such as CRM, data analytics and digital marketing, TENDAM uses the services of different companies that can process data outside the European Union. At present, these services and companies are the following:

Customer data analytics by IBM - Legal protection: Type contractual clauses.
Advertising to users of digital platforms through the services of Google Adwords or the creation of Customized Audiences of Facebook - Legal protection: Type contractual clauses.

In any case, TENDAM will ensure that appropriate measures are taken to ensure that the provider applies a level of security equivalent to that required by European data standards.

Apart from the aforementioned assumptions, TENDAM does not communicate your personal data to third parties, except for legal obligations or that are necessary to execute the contract.

7. What are your rights when you provide us with your personal data?

The rights that assist you against TENDAM due to the processing of your personal data are the following: the right to access your personal data, rectify inaccurate data, request its erasure, restrict any of the processing activities or oppose to any use (for example, oppose to sending of advertising later) and portability of your data. Right of access

You will have the right to obtain from TENDAM a confirmation of whether or not we are processing personal data that concerns you, as well as information about: the purposes of the processing; the categories of data that are processed; the recipients or categories of recipients to whom they have communicated or will be communicated; if possible, the expected period of conservation of personal data or, if this is not possible, the criteria used to determine this period. In these cases, TENDAM will provide you with a copy of the personal data that is being processed. In addition, when you request it by electronic means, the information will be provided in an electronic format of common use.

In the cases in which manifestly unfounded or excessive requests are made, especially for repetitive ones, TENDAM may charge a fee that compensates the administrative costs of attending the request corresponding to the true cost of processing the application.

TENDAM will inform you about the actions derived from your request within a month (which may be extended by two more months in case of especially complex requests, an extension that we would notify you within the first month). If TENDAM decides not to comply with an application, it will inform you of this, and we will motivate the refusal, within a period of one month from when you submitted the request.

Right to rectification

You have the right to request that TENDAM rectifies personal data when it is inaccurate or that it is completed when it is incomplete. If you are registered on our Platform, it may be easier for you to correct them directly by modifying the profile.

Right to erasure/ right to be forgotten

You will have the right to obtain from TENDAM the erasure of personal data that concerns you when one of the following circumstances occurs:

  1. It is not necessary in relation to the purposes for which they were collected or processed;
  2. You withdraw your in consent and the processing is not based on another legal basis;
  3. You object to processing and other legitimate reasons for processing do not prevail;
  4. It have been processed illicitly.

When the erasure derives from the exercise of the right to opposition for direct marketing purposes, TENDAM may conserve your identifying data in order to prevent future processing for these purposes.

When TENDAM has made public the personal data and is obliged to suppress such data, TENDAM, taking into account the available technology and the cost of its application, will adopt reasonable measures, including technical measures, with a view to informing those data controllers who are processing the personal data of your request to delete any link to that personal data, or any other copy or reproduction of them.

Right to restriction of processing

You will have the right to obtain from TENDAM the restriction of processing of the data when any of the following conditions is met:

  1. when you have challenged the accuracy of your personal data, during the period that allows TENDAM to verify its accuracy;
  2. in the event that you consider that the processing is illegal and TENDAM has opposed to the erasure of personal data and instead you request the limitation of its use;
  3. that TENDAM no longer needs personal data for the purposes of the processing, but you need them to formulate, exercise or defend claims;
  4. in the event that you have opposed the processing, while verifying if the legitimate reasons of TENDAM prevail over yours.

When you have obtained the restriction of processing according to this section, you will be informed by TENDAM before the lifting of the referred restriction. TENDAM will communicate any rectification, erasure of personal data or restriction or processing to each of the recipients to whom the personal data have been communicated, unless it is impossible or requires a disproportionate effort. TENDAM will inform the data subject about said recipients, if you request it.

Right to portability

You have the right to receive personal data in a structured, commonly used and machine-readable format, and to transmit it to another party when the processing is based on consent or a contract and is carried out by automated means.

By exercising your right to the portability of data, you will have the right to have personal data transmitted directly from data controller to data controller when technically possible. The exercise of this right shall be without prejudice to the powers granted by the right of erasure.

This right to portability shall not apply to the processing necessary for the fulfilment of a mission carried out in the public interest or in the exercise of public powers conferred on TENDAM. The right to portability will not be extended to the data that TENDAM would have inferred from data that derive directly from the use by TENDAM of the services provided.

Right to oppose

You will have the right to oppose to the processing of data that concerns you, at any time, including profiling. In case you exercise this right, TENDAM will cease processing your personal data, unless we prove legitimate reasons for the processing to prevail over your interests, rights and freedoms, or for the formulation, exercise or defence of claims.

When the processing of personal data is aimed at direct marketing, you will have the right to oppose at all times the processing of personal data that concerns you, including the preparation of profiles to the extent that it is related to the aforementioned marketing strategy. Therefore, personal data will no longer be processed for the referred purposes.

Automated individual decision-making

You have the right not to be the subject of a decision based solely on automated processing, including profiling, that produces legal effects on you or significantly affects you in a similar way. However, it will not be possible to exercise such right in case the decision is necessary for the execution or execution of a contract between you and TENDAM; is authorized by the law applicable to TENDAM provided that it establishes adequate measures to safeguard your rights, liberties and legitimate interests; or is based on your explicit consent.

Right to lodge a complaint

You have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD), especially when you have not obtained satisfaction in the exercise of your rights.
